Terms of Service

These Terms are an agreement between you and Streak Running App, LLC ("Streak," "we," "us"), a Maryland limited liability company. They cover your use of the Streak mobile app and the streakrun.app website (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

1. Eligibility and accounts

You must be at least 13 years old to use Streak. If you are under the age of majority where you live, you need a parent or guardian's permission.
Give accurate information, keep your password secure, and tell us if you think someone else has accessed your account. You're responsible for activity on your account.
One person per account. Don't create accounts for others or impersonate anyone.

2. Health and safety

Streak is a fitness tracking and community app. It is not a medical device and doesn't give medical advice. Stats like distance, pace, calories and heart rate zones are estimates and may be inaccurate. Talk to a doctor before starting or changing an exercise program.

Running carries risk of injury. You take part in runs, challenges and group activities at your own risk.
Pay attention to your surroundings, obey traffic laws, and don't use the app in ways that distract you from running safely.
Challenges are for motivation. Never push past what is safe for you to complete one.

3. Your content

You own the runs, photos, notes, comments and posts you add ("Your Content").
You give Streak a worldwide, non-exclusive, royalty-free license to host, store, copy, display and process Your Content only as needed to operate, improve and provide the Service, including showing it to the people you choose to share it with. This license ends when you delete the content or your account, except for copies in backups that are deleted on their normal schedule, or content others have already shared or saved within the Service where that's how the feature works.
Only post content you have the right to share, and don't post photos of other people without their permission.

4. Community rules

Don't use Streak to:

harass, threaten, bully or impersonate anyone, or post hateful, sexually explicit or violent content,
share someone else's location, home address or personal information without permission,
post spam, scams or ads, or run unauthorized contests,
fake or manipulate runs, distances or leaderboard results,
break the law or infringe anyone's rights, or
scrape, reverse engineer, overload or interfere with the Service, or access data you aren't permitted to see.

We may remove content, reset challenge results, or suspend or close accounts that break these rules. You can report a problem by contacting us.

5. Third-party services

Streak works with services such as Apple Health, Health Connect, Bluetooth sensors and maps. Those services are governed by their own terms, and we're not responsible for their availability or accuracy.

6. Paid features

Streak is free today. If we offer paid features or subscriptions, they'll be sold through the Apple App Store or Google Play and billed under their terms. Subscriptions renew automatically until you cancel in your App Store or Google Play account settings. Refunds are handled by Apple or Google under their policies. We'll show prices and terms before you buy.

7. Our rights

The Service, including the app, design, logos and software, belongs to Streak Running App, LLC and is protected by law. We give you a personal, non-transferable, revocable license to use the app for your own non-commercial use under these Terms. We may change, add or remove features, and we may suspend or end the Service.

8. Ending your account

You can delete your account at any time in Settings. We may suspend or close your account if you break these Terms or if needed to protect users or the Service. Sections that by their nature should survive, including 3 (license for backups), 9, 10 and 11, survive termination.

9. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the Service will be uninterrupted, error-free or that data will never be lost, and we aren't responsible for the conduct of other users.

10. Limitation of liability

To the fullest extent the law allows, Streak Running App, LLC and its members and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or $50. Some places don't allow these limits, so they may not fully apply to you.

11. Indemnity

If you use the Service in a way that breaks these Terms or the law, and that leads to a claim against us, you agree to cover the reasonable costs, including legal fees, to the extent the law allows.

12. Governing law

These Terms are governed by the laws of the State of Maryland, without regard to conflict of law rules. Any dispute will be handled in the state or federal courts located in Maryland, and you and we consent to their jurisdiction, unless the law where you live gives you a right to bring a claim locally.

13. Apple-specific terms

If you downloaded Streak from the Apple App Store: these Terms are between you and Streak, not Apple. Apple has no obligation to provide maintenance or support for the app. If the app fails to meet any applicable warranty, you may notify Apple for a refund of the purchase price (if any), and Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app, including product liability, legal compliance or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Changes

We may update these Terms. If changes are material, we'll notify you in the app or by email before they take effect. Continuing to use Streak after that means you accept the updated Terms.
